The Client is responsible for all travel, accommodation, meal and transport costs. These are included if within Southampton postcode area. If outside of Southampton travel is charged at 40p per mile. Any distances beyond 100 miles accommodation costs will be due.

It is agreed that the terms set out in this Terms of Agreement and Conditions form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Booking Deposit & Balance Payment: The due deposit must be paid by The Client to reserve the services of The Photographer. If you decide to cancel your booking within 7 days of the booking date your deposit will be refunded in full. The deposit will not be refundable should a cancellation occur after 7 days of the booking date. Your balance payment is due 21 days prior to the wedding. In the event of a late cancellation after the balance has been paid we regret that there will be no refund of the balance payment.

Venues: It is The Client’s responsibility to provide the full postal address of all the venues to be attended by The Photographer.

Cancellation: The Client may cancel this contract at any time by giving written notice to The Photographer and shall forfeit any monies paid. Should The Photographer receive the cancellation within eight weeks prior to the date of the ceremony The Client will pay the sum of 60% of the current value. The said sum shall be payable as compensation, this amount being agreed the estimated loss to The Photographer.

Display: I hereby allow The Photographer to display any photograph/s included in this contract in their studio, portfolio’s, literature, wedding exhibitions, web site and advertising. If you do not wish your photograph/s to be used, please notify us in writing prior to your wedding. The Photographer will make no use of the photographs for other commercial reason except with the permission of The Client in writing.

Photographs: The Photographer will provide a pleasing colour balance, but cannot guarantee exact colour matching owing to anomalous reflections caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film the exact colour as seen by the human eye.

Copyright: Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer in writing.

Licence: The Photographer shall be granted artistic licence in relation to the poses photographed and the location used. The photographer’s judgement regarding the location, poses and number of photographs taken shall be deemed correct. Due to the variations in weather conditions and the willingness of subjects, it may not be possible to capture all the photographs requested.

Attendance: Your photographer will be in attendance at your wedding for up to the hours agreed. If a photographer is required for a longer period of time, prior arrangements should be made and appropriate fees paid.

Special Requests: Special requests are not binding instructions, although every effort is made to comply with the client’s request.

The Photographer: On occasions and without notice it may be necessary for the photographer originally specified or requested to be substituted by another photographer, (e.g. due to ill health).

Force Majeure or Act of God: The due performance of this contract is subject to alteration or cancellation by The Photographer owing to any cause beyond their control. In the unlikely event of a total photographic failure or cancellation of this contract by The Photographer liability shall be limited to a full refund of all monies paid.

Proofs/Previews: After the wedding, The Photographer will provide the Client with a watermarked low resolution Proof Images via a web link. This Proof Images link will contain all photographs (in colour) taken at the event. All photographs will have a watermark embedded, prohibiting unauthorised use. The Client should as soon as possible provide The Photographer with a list of desired images to be supplied as high resolution JPEGS (corresponding to the amount of images agreed upon in this contract).

Reorders: All orders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing. Print, reprints, framed prints, title pages and parents albums will be at the price ruling at the time of order.

Digital Files: All digital files remain the property of The Photographer and shall be kept by them for a period of 2 years from the date of ceremony.

Complaints: Any complaint should be raised by the Client with The Photographer in writing within 28 days of first becoming aware of the matter to be complained of and in any in any event within 28 days of receipt of the images.

Event Guide: The Client will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will NOT be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).

House Rules: The photographer is limited by the guidelines of the ceremony official or the reception site management. The Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client's responsibility; The Photographer will offer technical recommendations only.

Completion schedule: The printing process can only start once The Photographer receives the order list for the required images. Digital processing takes approximately 2 weeks.

Co-operation: The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. The Photographer is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, neither for missed images due to details not revealed to The Photographer.

The Photographer takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs being lost, stolen or destroyed for reasons within or beyond The Photographers control, the latter’s liability is limited to the return of all payments received for the event package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Non-guarantee: Although every possible care will be taken to produce photographs of all important and special events during the wedding, The Photographer cannot place an unconditional guarantee on the above. The Photographer will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of The Photographers control.
